Abstract

The purpose of this study is to determine the regulation of online transaction systems (E-commerce) in terms of the Law on Information and Electronic Transactions (ITE); and also to find out the legal requirements for online trading greements (E-commerce) in terms of the Law on Information and Electronic Transactions (ITE). This research is a type of research that uses normative legal research methods using several approaches including the statutory approach (statue approach), and the conceptual approach. In this study the problem was formulated namely How is the regulation of online transaction systems (E-commerce) in terms of the Law on Information and Electronic Transactions (ITE)? And What are the conditions for the alidity of the online purchase agreement (E-commerce) in terms of the Law on Information and Electronic Transactions (ITE) ?. The conclusion obtained in this study is that an agreement was declared born at the time of reaching an agreement or agreement between the two parties regarding a subject matter that became the object of the agreement. Agreeing here means an agreement of understanding (opinion) and desire between the two parties. In that context there will be a will meeting between the two parties to do or not do an agreement. And also the validity of an online purchase agreement by a party with a different legal system, remains valid. This can be seen even though different legal system agreements occur because there is an agreement in advance between the parties, where when they want to enter into an e-commerce contract, the parties can determine the legal choice and which forum choice is the basis for implementing e-commerce and the second agreement parties if a dispute occurs in the future.
