Abstract

Indigneous people of Bayan are known as indigenous people of Bayan because in their lives, they always apply customary rules or laws without leaving (disregarding state law). Related to this, this research aims to; 1) knowing the existence of cutomary law in the aspect of marriage in the Bayan Village community Bayan District and 2) Knowing the factors that support and inhibiting the exsitence of customary law in the aspect of marriage in the Bayan Village community Bayan District. Before counduting research, the author needs to describe the theories related to the problem of this research. The authors explain the theoris in the literature rivew. In this section the opinions of experts related to the review are elaborated; 1) Customary Law, 2) Social, 3) Culture, and 4) Community. The approach used in this research is a qualitative approach with empirical sociology methods. This research was conducted in the Bayan Village, Bayan District, North Lombok Regency, West Nusa Tenggara Province. The sampling technique in this study is the purposive sampling technique with the Bayan Village community as the sample. Sources of data in this study are primary data sources and secondary data sources. To collect research data observation, interview, documentation and literature study techniques are used. Furthermore, the data obtained from the field are analyzed by comparison, then analyzed to draw generalizations or conclusions. This research concludes that up to now the Bayan community has always carried out traditional marriages with a marriage system called Mulang, which in the process began with the Mulang implementation, which at the peak of the event was carried out by the Customary Marriage tradition. This proves that until now the existence of customary law in the socio-cultural life of the community is still strong. Factors supporting the existence of customary law in Bayan community marriages are: 1) Strong Bayan traditional marriage system, 2) Strong Bayan traditional marriage principles, 3) Concept of Bayan community life, 2) Still existence of Bayan customary institutions in monitoring the course of Bayan customary law, and 4) Strict customary law sanctions that apply to Bayan Village communities. Furthermore, in general factor that inhibits is the desire of local people to change their living systems and the lack of Bayan young people who appreciate the value of customs.
